Service Terms and Conditions

General
1. All lagoon cruises and eco tours require a minimum of 10 passengers to enable a departure.
2. All guests are required to arrive at least 30 minutes prior to departure. Featherbed Co reserves the right to depart all vessels as scheduled.
3. Any cruise or tour may be cancelled, due to unforeseen circumstances, including but not limited to, extreme weather conditions.
4. All cruises and tours will commence with a safety briefing as required by the South African Maritime Law. No persons are permitted to jump overboard and/or swim.
5. All vessels, with the exception of Threelegs, are licensed floating restaurants with full cash bar facilities therefore no food or beverages may be taken on board any of our vessels.
6. Featherbed Co reserves the right of admission.
7. No alcohol will be sold to children under the age of 18 years.
8. Featherbed Co reserves the right to amend the current terms & conditions without notice.
PAYMENTS & CANCELLATIONS
1. Please note that a reservation is not confirmed or secured until the payment requirements have been met. The Featherbed Company reserves the right, without notice to the Company/guest/group/independent traveler (hereinafter referred to as “the guest”), to release any bookings held where the required pre-payment has not been made within the stated period.
2. No refunds will be paid for no shows, late arrivals or guest cancellations.
3. Please ensure the correct passenger numbers, date and departure time are confirmed as you are liable for the full fee according to your confirmation.

Cancellation Policy:

If cancelled within:
o 72 hours of arrival, no cancellation fee will apply
o 48 hours or less - 50% cancellation fee will be charged
o 24 hours or less - 100% cancellation fee will be charged
o All cancellations must be in writing (by email) and will only be valid on receipt of written confirmation of cancellation from Featherbed Co.
o All changes must be done at least 48 (forty-eight) hours in advance.

4. All cancellations must be received in writing and will only be valid on receipt of a written cancellation confirmation from The Featherbed Company.
5. Any changes must be at least 48 (forty-eight) in advance, especially when there are meal arrangements.
6. In the event of unfavorable weather conditions Featherbed Co will only make the final judgement on the departure no later than one hour prior to the scheduled time. All guests will be notified telephonically should a tour or cruise be cancelled.
7. In the event of any tour or cruise being cancelled by the management of Featherbed Co, a full refund will be given on the amount paid (or refunded to the booking agent).
8. All requests for amendments to a reservation are required in writing by fax or email at least 48 (forty-eight) hours prior to the date of departure. Amendments may be approved subject to availability in the sole discretion of Featherbed Co-Management.
9. All refunds will only be processed via EFT.
CHILD POLICY
1. All children (0- 12 years) are classified as a passenger. Children over 12 will be charged the full adult rate.
2. Children 4 to 12 will be charged the child rate. Children 3 and under will be complimentary.
3. Please note that no children will be permitted to sit on parents’ laps. Children regardless of age, is classified as a seat.
4. No unaccompanied minors are allowed on any vessels or tours.

Payments
• Prepayment is required when making a booking; a reservation number will be confirmed by receipt thereof.
• Bookings not accompanied by a payment will be released unless alternate arrangements have been made in writing.
• Refunds will not be considered for no-shows or late arrivals.
• Ensure all booking details are correct when making payment.

Cancellation/no-show charges
• Cancellations are required in writing 48 (forty-eight) hours prior to arrival, to avoid charges.
• On receipt of a cancellation a reference number will be issued in writing.
• Passenger numbers are to be amended 48 (forty-eight) hours prior to arrival, to avoid incurring additional charges.
• In the event of adverse weather conditions, Featherbed will make the final call no later than one hour prior to departure. Guests will be notified telephonically.
• Should a cruise be cancelled, a full refund will be issued to the paying party.
• Date changes are dependent on availability and must be requested via e-mail.
• Refunds will be processed as per the payment method received.

Child policy
• All children, 4-12 years & 3 years and under, are classified as passengers.
• Children under 3 (three) years of age are complimentary.
• The child rate (4 – 12) is 50% of the adult rate. (Seasonal)
• Children 13 (thirteen) years and older are charged the adult rate.
• No unaccompanied minors are permitted on the boats.

Customer Privacy policy
Featherbed Co shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa and MasterCard.
Card acquiring and security
Card transactions will be acquired for Featherbed Co via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Featherbed Co separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
Responsibility
Featherbed Co takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Country of domicile
This website is governed by the laws of South Africa and Featherbed Co chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Featherbed Co may, in its sole discretion, change this agreement or any part thereof at any time without notice.
